Policies of
Parkside West

This page is filled with information regarding some of the current rules and policies of our neighborhood. Anything not covered here will be in our CC&Rs located on the DOCUMENTS page.

Collection Policy

Regarding Quarterly Dues and Delinquency. 

If a homeowner fails to pay their assessment within 30 days of the due date (the first day of the month), the Homeowners Association (HOA) will issue a formal notice 15 days later. This notice will outline the outstanding balance and inform the homeowner that they have 30 days to either remit full payment or request a payment plan.

In total, homeowners are provided with a 75-day period to resolve the delinquency. If there is no response or resolution within this timeframe, the account will be referred to the HOA's attorney for further collection efforts.

Once an account has been transferred to the attorney, all communications regarding the debt must be directed to legal counsel. At this stage, no payment plans will be offered, and the homeowner will be held responsible for all associated legal fees, court costs, penalties, and interest. These charges are non-negotiable and will not be waived.

A Notice of Intent to Lien will be filed, and if the balance remains unpaid, foreclosure proceedings will commence 45 days thereafter.

If a homeowner enters into a mutually agreed-upon payment plan but subsequently defaults, the lien and foreclosure process will continue. To halt this process, the full outstanding balance—including all attorney fees, court costs, penalties, and interest—must be paid in full.

Committee Member Eligibility

Any committee or board member who becomes delinquent in any fees owed to the Association shall be considered ineligible to continue serving. As a result, the member will be deemed to have voluntarily relinquished their position on the board of directors or committees.

Parking Policy

All residents are reminded to review and adhere to the Parkside West (PSW) community parking policies. These rules are in place to ensure the safety, accessibility, and well-being of all residents, and to maintain clear passage for emergency, postal, and delivery vehicles.

Recent Concerns:
There have been multiple instances of vehicles and trash bins obstructing access to mailboxes. Continued violations may prompt the U.S. Postal Service to require the removal of individual street-side mailboxes in favor of centralized "cluster" mailboxes—potentially located near community common areas, such as the playground. To avoid this outcome, your cooperation is essential.

Key Reminder:
Do NOT park or place trash bins within 10 feet of any mailbox during delivery hours (9:00 AM – 6:00 PM).

Parkside West Parking Rules

  1. No parking within 30 feet of any inside curve.

  2. No parking within 30 feet of a stop sign.

  3. No parking within 15 feet of either side of a fire hydrant.

  4. Extended parking is defined as any vehicle remaining in the community for more than one (1) week without leaving the premises.

  5. Recreational vehicles (RVs): Homeowners are allowed a maximum of 48 hours to load or unload RVs. Board approval is required for longer periods. Guests are not permitted to park RVs in the community.

  6. Trailers of any kind are not permitted, whether attached to a vehicle or not. Commercial vehicles larger than a standard pickup truck are only allowed temporarily for delivery, moving, repairs, or service calls.

  7. No parking within 10 feet of any mailbox between 9:00 AM and 6:00 PM.

  8. Do not park on the grass strip between the sidewalk and the street.

  9. Inoperable or unregistered vehicles are not permitted on streets or in driveways.

  10. Residents are encouraged to maximize use of their driveways before parking on the street.

  11. Avoid parking directly opposite another vehicle whenever possible to allow emergency vehicle access.

  12. Towing enforcement is in effect. Vehicles in violation of these rules may be towed at the owner’s expense. No vehicle will be towed without prior approval from the Board of Directors.

  13. Yellow-painted curbs identify designated NO PARKING zones and correspond to rules 1, 2, and 3 above.

Hurricane Shutter Policy

Rules for Seasonal and

Year-Round Residents

Seasonal Residents (Snowbirds):
Seasonal residents may close or install hurricane shutters on the side and rear windows of their home upon departing the community in the spring. Shutters on front-facing windows may only be closed or installed within five (5) days of a named storm.

Year-Round Residents:
Residents who live in the community full-time may close or install hurricane shutters on any part of the home within five (5) days of a named storm. All shutters must be removed within two (2) weeks after the storm has passed.

Shutter Removal Requirements:

  • Year-Round Residents: All shutters must be removed within two (2) weeks after the storm.

  • Seasonal Residents: Front-facing shutters must be removed within two (2) weeks after the storm.

Notification Requirement for Seasonal Residents:
Seasonal residents are required to notify Nexus Realty Management prior to leaving the community and installing shutters. Contact information for Nexus Realty Management is provided at the bottom of this page.

Spa & Hot Tubs

ARC Application is Required

Above-ground spas and hot tubs are permitted within the community, provided they do not exceed 84 inches in either length or width or diameter.

Please note:

  • Combination swim/spa units are strictly prohibited, as they are classified as pools under community guidelines.

Prior to installation, homeowners must:

  • Submit an ARC (Architectural Review Committee) application for approval.

  • Include supporting documentation showing that the spa or hot tub will be:

    • Enclosed within a fenced area with a locking gate, or

    • Located within a locked, screened enclosure.

Painting the Exterior of Your Home

ARC Application is Required

Any resident planning to paint the exterior of their home—even if using the same existing colors—must contact the ARC (Architectural Review Committee) Chairman, Al Bilotti, before beginning any painting project.

Important Requirements:

  • The main body color of your home must be different from the homes immediately to the left and right of your property.

  • The garage door can be painted with either the main body color or the trim color only.

  • Do not purchase paint or begin painting until you have received ARC approval.

Approved Color Matching:

  • The only store authorized to match the official PSW color palette is the Sherwin-Williams store on Palm Bay Road.

  • Mention you're a Parkside West resident to receive a 40% discount. Ask for Clarance or Terry.

🛒 Note: You are not required to purchase paint from Sherwin-Williams; however, if you choose a different vendor, your selected colors must closely match the approved PSW palette. In this case, you must submit color swatches along with your ARC application for review.

ARC Application Is Mandatory:

All homeowners must submit an ARC application prior to painting. This allows the committee to ensure the chosen colors comply with community standards.

⚠️ Warning:
If a home is painted without prior ARC approval, the homeowner may be required to repaint the home at their own expense.

Please Note:
Homeowners are no longer required to apply sample colors to the exterior of their home. This outdated requirement has been removed due to the difficulty in obtaining small-sized samples.

Pool Parties

Pool parties are permitted at the Parkside West community pool under the following conditions:

  • Shared Access: The pool remains open to all PSW residents during any scheduled party. Exclusive use of the pool is not permitted.

  • Guest Limit: To ensure the safety and enjoyment of all residents, party organizers must limit the number of guests to 25 or fewer.

  • Responsibility: The resident hosting the event is fully responsible for the conduct of their guests and for any damage that may occur as a result of the gathering.

  • Clean-Up: Hosts are required to thoroughly clean the pool and cabana areas following their event, removing all trash and personal items. If furniture is moved, please relocate it. 

  • Prohibited Items: Glass containers and alcoholic beverages are strictly prohibited in the pool and cabana areas at all times.

Failure to comply with these guidelines may result in loss of pool privileges and/or additional action by the Board of Directors.
